Westchester County Imposes Deadline on Coop Boards Deciding Purchase Applications

On November 19, 2018, the Westchester County Board of Legislators passed a law imposing a decision deadline for coop boards on applications to transfer title to a unit.

Under the new legislation, coop boards will have 15 days to inform a purchaser whether or not their application to purchase a unit is complete.  Once an application is deemed complete, a coop board will have 60 days to accept or reject the application.  If an application is rejected, the coop board must send a notice of the rejection to the Westchester County Human Rights Commission, which has the power to investigate discrimination under the Westchester County Fair Housing Law.

Notably, the new law does not require the coop board to include the reason an application is rejected.
