This series of short articles, or blogs, is designed to shed some light on the process by which parties enter into a Commercial Lease in New York. The blog is written by an experienced lawyer in plain English for the benefit of non-lawyers. We have attempted to break down complicated documents into “bite size” pieces that are easy to digest. Each article is designed to stand on its own or work together as part of the series.
Over the past 20 years, we have observed that many of our clients share similar concerns, and many of the same issues surface. For example, many clients wish to gain a better understanding of the rent commencement date, the indemnification clause and assignment and subletting clauses. In many deals there are guaranties, commencement date clauses and other issues that are negotiated by the attorneys. This series of articles is designed to answer some of these common questions and address some of these recurring issues.
Knowledge is power and we hope that this blog series empowers individuals to ask the right questions, understand the process and resolve issues early in the process to increase the likelihood of a achieving a fully executed lease.
