The New York Department of State has proposed a new regulation to specify that discrimination is unlawful and to clarify that a finding of discrimination by a court or agency against a real estate licensee will constitute evidence of untrustworthiness in a Department of State disciplinary proceeding. A violation could result in a broker’s license being suspended or revoked, in addition to fines and restitution. The definition of discrimination is quite broad and includes treating someone differently based on their race, religion, color, sexual orientation, marital status, criminal history, disability, predisposed genetic characteristics, etc.
