David Hall, Esq., attended the March 2022 Westchester County Bar Association Cannabis Committee meeting. The Committee has been actively working with the Governor’s Office and the Office of Cannabis Management (“OCM”) to lay out a responsible regulatory framework so that Cannabis can be sold in New York as soon as possible. One exciting development to report is the licensing of Conditional Adult Use Retail Dispensary.
On March 10, 2022, the New York Cannabis Control Board (“CCB”), which serves as the oversight body of the OCM, released draft regulations for conditional licenses for adult-use retail dispensaries.
The first round of licenses will be set aside for businesses run by owners disproportionately impacted by the criminalization of cannabis. To be eligible for this initial license, applicants must:
- Have had a pre-MRTA cannabis related offense in the State of New York, or had a parent, guardian, child, spouse, or dependent with a pre-MRTA cannabis related offense in the State of New York.
- Have experience owning and operating a qualifying business in the State of New York.
These licenses will be effective after a public comment period. The creation of these conditional licenses is an important step in launching New York’s legal cannabis market. The OCM is hopeful that they can begin accepting retail applications in the summer of 2022. These licenses would then be awarded later in the summer or fall of 2022. If all goes as planned, retail stores will open before the end of 2022.
The Cannabis Control Board’s regulations offer guidance to cannabis businesses so that they understand the parameters in which they will need to operate.
