As the co-chair of the Westchester County Bar Association’s Environmental Law Committee, I recently taught a seminar on Environmental Due Diligence for commercial real estate transactions. My presentation focused on the legal framework for environmental due diligence under applicable federal, state, county and local laws. Seth Mandelbaum, Esq. discussed contractual provisions relating to environmental due diligence, such as environmental indemnification and contingency clauses. Bill Canavan from Hydro Environmental solutions presented a power point presentation about the content of a Phase I Environmental Site Assessment and told a few “war stories” that illustrate the importance of retaining a qualified environmental professional.
The seminar was well attended by local attorneys and affiliated members. Attendees asked excellent questions. I look forward to covering more topics of interest in 2016.
