On June 26, 2019 the Appellate Division, Second Department, affirmed the Westchester County Supreme Court decision, holding that the plaintiff in Premium Cornerstone Properties, LLC v. S&R Main Realty, LLC was not entitled to specific performance on a Contract of Sale because the contract had expired by its terms and subsequent discussions did not give rise to an enforceable contract.
