Estate Planning in New York (including certain notarized and witnessed documents) is generally recommended to any individual over the age of 18 regardless of their marital status or net worth. Estate Planning has many benefits including allowing a person to decide how their assets will be distributed after they are gone, choosing a guardian for children and pets, and appointing someone they trust to make health care decisions in the event they become incapacitated.

Basic Estate Planning services typically include a Last Will and Testament, Health Care Proxy/Living Will, HIPAA Release and Power of Attorney. An experienced attorney knows the right questions to ask, how to determine whether more sophisticated tax planning and trust vehicles are recommended, and perhaps most importantly, how to draft the documents so that the person’s wishes are clear and unambiguous, and ultimately carried out.
